1. Use of the Site

2. Products, Purchases and Promotions

2.1 Product Information: The Site may make available listings, descriptions, and images of goods and services (collectively, “Products”). Such Products may be made available by us or by third parties. We make no representations as to the completeness, accuracy, reliability, validity, or timeliness of such listings, descriptions, or images (including any features, specifications, and prices contained on the Sites). Such information and the availability of any Product are subject to change at any time without notice. We have made efforts to accurately display the attributes of Products, including the applicable colors. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will accurately reflect actual product color or finish. In addition, certain weights, measures, and similar descriptions are approximate and are for convenience only.

2.2 Availability of Products: Information on the Site may reference Company Products that might not be available in your location. Such references do not imply that the Company plans to make such products and promotions available in your location. Please contact the Company representative for more information. Product prices may differ depending on your location.

2.3 Pricing Errors: In the event a Product is listed at an incorrect price due to typographical error or error in pricing information, we reserve the right to refuse or cancel any orders placed for the Product listed at the incorrect price.

2.4 Promotions; Discount Codes: We reserve the right to end any promotions, discount codes or sales early and without notice, at the Company’s convenience.

3. Orders and Payments

3.1 Order Acceptance: Your order is an offer to buy, and we reserve the right to accept or decline your offer for any reason.

3.2 Payment: By providing payment information, you represent and warrant that you have the legal right to use any payment method(s) utilized.

3.3 Cancellation: We reserve the right to refuse or cancel any orders in our sole discretion, including but not limited to cases of pricing errors, inaccurate product information, or suspected fraud.

4. Shipping; Returns and Refunds

4.1 Shipping: Risk of loss and title for items purchased pass to you upon delivery to the carrier.

4.2 Returns: Our return policy is 15 days from your receipt of the Product. The Product must have been purchased at the then-current full/regular retail price and be in new condition with original packaging for a full refund. You will need to email our customer service at atyourservice@revelryhome.com to receive a RA number. You will also be responsible for shipping the product back to us. We reserve the right to refuse returns or to charge a restocking fee at our discretion. We do not offer refunds on any Product purchased at less than full/regular retail prices (i.e., sale prices).

4.3 Refunds: Provided that all of the criteria in Section 4.2 are fully satisfied (as determined by the Company), following the Company’s receipt and acceptance of the returned Product, the Company shall refund the purchase of the returned Product (less any restocking fee, if applicable) by crediting your original method of payment. If Product was designated as a gift when purchased and shipped directly to you, and such Product is otherwise eligible for return and refund in accordance with Company policies, you’ll receive a gift credit for the value of your return (less any restocking fee, if applicable). Once the returned Product is received, inspected and approved by Company in accordance with our policies, a gift certificate will be mailed to you. If the Product is not designated as a gift when purchased, or if the gift giver (i.e., original purchaser) had the order shipped to themselves to give to you later, and the Product is otherwise eligible for a return and refund in accordance with Company policies, we will send a refund to the gift giver (i.e., original purchaser) and notify them of your return.

4.4 Replacement of damaged Products: Our replacement policy for a damaged Product is 15 days. You will need to email our customer service at atyourservice@revelryhome.com to receive a RA number. You will also be responsible for shipping the product back to us at your expense.

5. Intellectual Property Rights

All content on the Site is the exclusive property of the Company and its licensors and is protected by copyright, trademark, and other intellectual property laws. Any use, reproduction, or distribution of Site content without express written consent is strictly prohibited.

6. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT WITH RESPECT TO THE SITE AND ALL CONTENT PROVIDED ON OR THROUGH THE SITE. 11. Governing Law and Jurisdiction; WAIVER OF CLASS ACTION AND JURY TRIAL

You agree that for any dispute you have with the Company, you will contact the Company first and attempt to resolve the dispute with the Company informally. These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its choice of law provisions. The parties hereby irrevocably submit and consent to the jurisdiction of all federal and state courts in New York and hereby irrevocably agree that the sole venue for all disputes under these Terms shall lie exclusively in New York County, New York. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAWS, ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU HEREBY AGREE THAT, BY AGREEING TO BE BOUND BY THESE TERMS, YOU AND COMPANY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

13. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the use of the Site and the purchase of any Products via the Site. By using our Site, you acknowledge that you have read these Terms, understood them, and agree to be bound by them.
